What Is a Retainer Agreement?

A retainer agreement memorializes the relationship between the attorney and client.  It is the contract that the attorney and client enter into and memorializes the scope of the legal representation, the rights and responsibilities of the client and how the attorney will be compensated for his legal services, among other things.  In New York State, attorneys are required to provide you with a retainer agreement as well as a Statement of Client Rights and Responsibilities.  Once you sign a Retainer Agreement, the attorney can start working on your behalf to safeguard your legal rights.  

Will I Be Required To Disclose My Medical Records?

Yes.  If you are claiming you sustained personal injuries, a defendant in a personal injury case (as well as the court) will have the legal right to examine and review your medical records to evaluate your injuries and your health condition.  The defendant will also have a legal right to have their own doctor examine you.  If you were involved in a prior accident with similar injuries, you may also have to disclose records regarding the prior accident as well.  When you consult with our office, we will request that you provide us with authorizations permitting our office to obtain your medical records in order to evaluate your claim and injuries before taking your case.  You can review the type of authorization you will have to fill out by clicking on HIPAA authorization.

Where Will My Case Be Venued?

Generally speaking, the venue of a lawsuit will depend on a number of factors such as where the accident occurred, where you reside, where the defendant resides, the type of lawsuit, etc.  Our office may decide to commence the lawsuit in Bronx County, New York County (Manhattan), Queens County, Kings County (Brooklyn), Richmond County (Staten Island), Nassau County, Suffolk County, Westchester County, Rockland County or in another county.  Selecting the proper venue for the lawsuit is an important decision which is made at the commencement of the case.  

How Long Will It Take For My Accident/Personal Injury Case to Be Resolved?

We cannot guarantee how long your case will take.  The length of time, from beginning to end, will depend on a number of factors.  Some of these factors include: how serious your injury is; what county the case is venued in; how many parties are named in the lawsuit; how cooperative or uncooperative the defendant is during litigation; whether the defendant is a public entity (cases against cities and municipalities generally take much longer); whether the defendant agrees to settle the case before trial; among other things.  If any attorney is guaranteeing you that your case will be settled by a certain date or time frame, then you should think twice about hiring any such attorney.  

What Should I Expect If I Decide to Sue?

1.  After you retain us as your lawyers, we can immediately start to work on your behalf;

3.  We will commence a lawsuit against the defendants;

4.   During litigation, in the "discovery" process, we will seek to obtain any documents in the defendant's possession that may be favorable to your case such as any accident reports;

How Much Is My Case Worth?

The value of each case depends on the type of case and the amount of insurance available.  For example, in car accidents, many drivers only have the basic liability insurance in New York which is usually $25,000.  An injury that occurred in a car accident may be valued "less" than in another type of accident simply because there is a minimal insurance policy that a plaintiff's attorney can go after.  The value of your case will also depend on whether you were "contributory negligent", whether you had any pre-existing injuries, your age and whether you lost time from work, and what county the case is venued in, among other things.  Any attorney guaranteeing you a settlement amount is unscrupulous and you should consider hiring another attorney.
